Court of Protection Solicitor | Leading Specialist Welfare Team | Support through Accreditation 

An excellent opportunity has arisen for experienced Court of Protection solicitors to join a highly respected specialist practice with a strong reputation in welfare work.

This growing team is regularly instructed on complex and sensitive matters involving mental capacity, welfare disputes, and best interests issues. The work is both challenging and rewarding, offering solicitors the chance to make a genuine difference while developing their expertise within a collaborative and progressive environment.

The firm is particularly well known for its work involving the Official Solicitor and has built an impressive reputation within this niche area of practice. Alongside a varied caseload, there is a clear pathway for progression and the opportunity to play an active role in mentoring and developing junior colleagues.

The Role

You will work on a broad range of Court of Protection welfare matters, including:

• Acting in proceedings involving vulnerable individuals and family members
• Advising on issues arising under the Mental Capacity Act 2005
• Managing welfare disputes and best interests matters
• Preparing court applications, witness evidence, and position statements
• Attending hearings, conferences, and meetings with clients and professionals
• Supporting and supervising more junior members of the team
• Working closely with counsel, experts, and external agencies on complex cases

The caseload is interesting and often high profile, making this an ideal move for someone looking to deepen their specialism within Court of Protection work.

About You

Applications are welcomed from solicitors with solid experience in Court of Protection welfare matters, ideally around 3 years PQE or above, although strong candidates outside this level will also be considered.

You should have:

• Experience handling welfare and mental capacity matters independently
• Strong knowledge of best interests decision making and Court of Protection procedure
• Excellent drafting and client care skills
• Confidence managing a busy and sensitive caseload
• A proactive and team oriented approach

Experience supervising junior colleagues or trainees would be beneficial, as would experience dealing with matters involving the Official Solicitor or more complex welfare applications.
